Terms of Service

1. Introduction
Welcome to GetDeposit ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the GetDeposit platform available at getdeposit.io, including our website, APIs, and any related services (collectively, the "Service").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
2. Definitions
- "Company" — a business entity that registers on GetDeposit to manage security deposits for its customers.
- "Customer" — an individual who pays or tracks a security deposit through the Service on behalf of a Company.
- "Deposit" — a security deposit created, collected, managed, and/or refunded through the Service.
- "Deposit Agreement" — the legally binding agreement between a Company and a Customer regarding a specific Deposit, facilitated through the Service.
- "Booking Code" — a unique, confidential identifier generated by the Service and provided exclusively to the Customer for authentication purposes. The Company does not have access to the Booking Code.
- "User" — any person who accesses the Service, including Company administrators, employees, and Customers.
3. Eligibility
You must be at least 18 years old and capable of entering into a binding agreement to use the Service. By registering a Company account, you represent that you have the authority to bind that entity to these Terms.
4. Account Registration
To access certain features you must create an account by providing accurate and complete information, including a valid email address. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
We may suspend or terminate accounts that violate these Terms, contain inaccurate information, or remain inactive for an extended period.
5. The Service
GetDeposit provides a platform that enables Companies to:
- Create and manage security deposits digitally.
- Collect deposit payments via card authorization holds through our payment partner, Stripe.
- Document and agree on the state of rented objects or properties via photo uploads.
- Audit objects for damages after use and process refunds or deductions accordingly.
- Track the complete deposit lifecycle from creation to resolution.
GetDeposit acts solely as a technology platform facilitating the Deposit Agreement between a Company and its Customer. GetDeposit is not a party to the rental agreement, the Deposit Agreement, or any other contractual relationship between a Company and its Customer. We do not own, manage, or insure any property or object associated with a deposit.
5A. Legally Binding Deposit Agreement
The Deposit Agreement facilitated through the Service constitutes a legally binding agreement between the Company and the Customer. Both parties acknowledge and accept that:
- By creating a Deposit through the Service, the Company enters into a binding Deposit Agreement with the Customer under these Terms and any applicable Company-specific terms.
- By accepting the terms and conditions presented during the deposit process, the Customer enters into a binding Deposit Agreement with the Company.
- The Deposit Agreement is binding upon both parties from the moment the Customer accepts the terms and conditions, and remains in effect until the Deposit is fully resolved (refunded, partially or fully captured, or otherwise settled).
- Both parties are obligated to act in good faith and in accordance with the terms of the Deposit Agreement and any applicable Company-specific terms.
- The documented state of objects or properties (including photographs and descriptions) recorded through the Service forms part of the binding Deposit Agreement and may serve as evidence in any dispute between the parties.
5B. Customer Identity Verification
Customers access their Deposit through the Service by entering their Booking Code and last name. The Booking Code is a unique, confidential identifier that is provided exclusively to the Customer and is not known to or accessible by the Company.
By logging in with a valid Booking Code and matching last name, the Customer verifies and confirms their identity as the authorized party to the Deposit. This authentication constitutes sufficient identity verification for the purposes of entering into the Deposit Agreement.
The Customer is solely responsible for keeping their Booking Code confidential. Any actions taken through the Service after successful authentication with a Booking Code and last name are attributed to and legally binding upon the Customer associated with that Deposit.
5C. Platform Disclaimer & Limitation of Responsibility
GetDeposit is solely a platform provider. GetDeposit facilitates the creation, documentation, and administration of Deposit Agreements between Companies and Customers. GetDeposit is not responsible for, and expressly disclaims any liability in connection with:
- Any claims, disputes, damages, losses, or disagreements arising between a Company and a Customer in relation to a Deposit, the condition of any property or object, or the terms of any rental or service agreement.
- The accuracy, completeness, or fairness of any audit, inspection, or damage assessment conducted by a Company through the Service.
- The amount of any Deposit, deduction, or refund determined by a Company.
- The enforceability or validity of any Company-specific terms presented to a Customer.
- Any financial loss suffered by either party as a result of or in connection with a Deposit Agreement.
All disputes, claims, and settlements arising from or relating to a Deposit Agreement must be resolved directly between the Company and the Customer. GetDeposit shall not act as a mediator, arbitrator, or adjudicator in any dispute between the parties. Neither party may bring any claim against GetDeposit in relation to the actions, omissions, or conduct of the other party.
Each party (Company and Customer) acknowledges that GetDeposit bears no responsibility for the outcome of any Deposit and that the use of the Service does not create any agency, partnership, joint venture, or employment relationship between GetDeposit and either party.
6. Payments & Fees
6.1 Deposit Payments
Deposit payments are processed through Stripe. When a Customer pays a deposit, an authorization hold (capture/block) is placed on their payment method. Funds are not immediately captured. The hold may be captured (partially or fully) or released depending on the outcome of the audit process.
6.2 Stripe Fees
Stripe transaction fees are billed directly through your connected Stripe account and are separate from any GetDeposit fees. Stripe fees are determined by Stripe at its sole discretion and may change from time to time. The exact fees depend on Stripe's applicable percentages and the type of credit or debit card used by the Customer.
Only full withdrawals (captures) or partial withdrawals are charged by Stripe. Authorization holds (captured/blocked deposits) that are subsequently released in full are free of charge under Stripe's current fee structure.
Stripe is an independent third party and is free to modify its fees, terms, and conditions at any time, independent of and without notice to GetDeposit. GetDeposit has no control over and accepts no responsibility for Stripe's fees or fee changes. Companies are responsible for reviewing and accepting Stripe's terms and fee schedule.
6.3 GetDeposit Fees
New Company accounts receive a free trial with a limited trial budget. During the free trial period, no GetDeposit fees are charged. Once the free trial budget is exhausted, the Company must upgrade to a paid plan to continue using the Service.
The paid plan is charged at 1% per deposit created through the Service. There are no monthly or recurring subscription costs. You only pay for what you use.
The paid plan is cancellable at any time, effective immediately. Upon cancellation, no further deposits may be created, but any existing deposits will continue to be processed through their lifecycle until resolution.
GetDeposit reserves the right to modify its fee structure at any time. Continued use of the Service after such changes take effect constitutes acceptance of the new fees.
6.4 Chargebacks & Payment Disputes
A chargeback occurs when a Customer disputes a deposit payment with their bank or card issuer. If a chargeback is filed against a deposit payment, the Company associated with that deposit is solely responsible for resolving the dispute and bearing any resulting costs, including but not limited to the disputed amount, chargeback fees imposed by Stripe, and any related administrative costs.
GetDeposit is not a party to the payment transaction between the Company and the Customer and shall not be liable for any chargebacks, payment disputes, or reversals. GetDeposit does not guarantee the outcome of any chargeback or dispute process.
Companies acknowledge that repeated or excessive chargebacks may result in suspension or termination of their Stripe Connect account and/or their GetDeposit account, at the sole discretion of Stripe or GetDeposit respectively.
6.5 Authorization Hold Expiry & Re-authorization
Deposit payments are collected as authorization holds on the Customer's payment method. Authorization holds are temporary and may expire after a period determined by the card network or issuing bank (typically 7 days). To maintain the hold for the duration of the booking, the Service automatically attempts to cancel and re-authorize the hold before it expires.
Re-authorization may fail for reasons outside the control of GetDeposit, including but not limited to:
- The Customer's card has been cancelled, expired, lost, or reported stolen.
- Insufficient available credit or funds on the Customer's payment method.
- The card issuer or bank requires additional authentication (e.g., 3D Secure / SCA) that cannot be completed without the Customer's direct involvement.
- The card issuer or bank declines the re-authorization for fraud prevention or risk management reasons.
GetDeposit is not responsible for failed re-authorizations or for any financial loss, exposure, or liability suffered by the Company as a result of an authorization hold that cannot be maintained. When a re-authorization fails, the Company will be notified promptly. It is the Company's sole responsibility to take any additional steps to secure the deposit or mitigate its exposure, including but not limited to contacting the Customer directly or making alternative arrangements.
Companies acknowledge that for bookings exceeding 7 days, the risk of re-authorization failure increases and should be factored into their risk management practices.
6.5.1 Customer Liability After Hold Release
The release of an authorization hold — whether due to expiry, re-authorization failure, bank policy, or any other reason — does not release the Customer from liability for damages, losses, or deductions arising from the Deposit Agreement. The Customer's obligation to compensate the Company for any documented damages remains in full force regardless of whether an active authorization hold exists on the Customer's payment method.
If the authorization hold has been released and the Company identifies damages or deductions owed under the Deposit Agreement, the Customer agrees to promptly provide a valid credit card or other accepted payment method to settle the outstanding amount. The Customer acknowledges that failure to provide a valid payment method does not extinguish the debt or liability owed to the Company.
By accepting the Deposit Agreement, the Customer expressly acknowledges and agrees that:
- Their liability for damages is determined by the terms of the Deposit Agreement and the outcome of the audit process — not by the status of the authorization hold.
- The release of the hold by the bank or card issuer does not constitute a waiver, release, or forgiveness of any amounts owed.
- They are obligated to cooperate with the Company to settle any outstanding amounts, including by providing an alternative payment method if the original hold is no longer available.
- The Company retains the right to pursue any unpaid amounts through all available legal and collection remedies.
6.6 Stripe Connect
Companies must onboard via Stripe Connect to receive deposit payments. By using this feature, you also agree to Stripe's Connected Account Agreement.
7. User Content
You may upload photos, documents, and other materials ("User Content") to the Service. You retain ownership of your User Content but grant us a limited, worldwide, non-exclusive license to store, process, and display it solely for the purpose of providing the Service.
You represent that you have the right to upload any User Content and that it does not infringe on the rights of any third party.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
- Upload content that is defamatory, offensive, or infringes on intellectual property rights.
- Attempt to gain unauthorized access to the Service, other accounts, or our systems.
- Interfere with or disrupt the integrity or performance of the Service.
- Use automated means (bots, scrapers) to access the Service without our prior written consent.
- Circumvent any security or authentication measures.
9. Intellectual Property
The Service, including its design, logos, text, graphics, and software, is owned by GetDeposit and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our prior written consent.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
11. Limitation of Liability
To the maximum extent permitted by applicable law, GetDeposit and its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages.
Without limiting the generality of the foregoing and in addition to the disclaimer in Section 5C, GetDeposit shall not be liable for any claim, damage, or loss arising from or related to any Deposit Agreement between a Company and a Customer, including but not limited to disputes over deductions, refunds, the condition of property or objects, or the interpretation or enforcement of any Company-specific terms.
Our total liability for any claim arising under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless GetDeposit, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your infringement of any third party's rights.
13. Termination
You may close your account at any time through the Service. We may suspend or terminate your access if you breach these Terms or if required by law. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will remain in effect.
Following termination or account deletion, we may retain transaction records, payment details, audit trails, and other financial data for up to 7 years as required by applicable tax, accounting, and regulatory obligations. See our Privacy Policy for details.
14. Changes to These Terms
We may update these Terms at any time. If we make material changes, we will notify you by email or through the Service. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
15. Governing Law & Disputes
These Terms are governed by the laws of the Netherlands. Any disputes arising out of or relating to these Terms or the Service shall be submitted to the competent court in Amsterdam, the Netherlands.
